If they do this, then eyes would be on Microsoft and not Farsight for not doing this in the first place.

Yea, the impression I get is that this wouldn't apply to Farsight. I don't know why MS is so bent on having to go through publishers, other than they themselves being a publisher and wanting to line their pocket off the work of others.
